When it comes to current events, you don’t have to look much further than recent trademark filings to see how others are trying to capitalize on coined terms. With that said, the Boston Beer company, maker of Samuel Adams beers and Angry Orchard hard ciders, is looking to capitalize on the U.K.’s recent exit from the European Union and has filed a trademark application for the term “Brexit” to protect the mark when it comes to hard ciders.
All in all, there have been 3 total applications for “Brexit.” The other two were filed by an individual in Chicago protecting the term on clothing, and a company in Colorado looking to protect the use of the term on nutritional and dietary supplements.
INTENT TO USE APPLICATION
Although there currently is not a Brexit cider available, the Boston Beer company has filed its application under an intent to use basis. Using this strategy, the name can essentially be reserved while the actual product is in development. With the amount of trademark mark disputes the brewing industry has seen in recent years, using intent to use applications is one way to stay ahead of the game.
