It’s been a busy week blogging about NFL related trademarks, including recent filings of YOU VIKE THAT! and FITZMAGIC, but next up is THE BAKER SPECIAL courtesy of the NFL’s newest starting quarterback, Cleveland’s Baker Mayfield.
It appears Mayfield’s representatives, Waterhouse Hayes LLC, have filed a trademark application to protect THE BAKER SPECIAL for the following classes of goods/services:
Advertising services; Advertising services relating to sandwiches; Advertising and commercial information services, via the internet; Advertising and marketing services, namely, promoting the goods and services of others; Advertising and promotional services; Advertising, marketing and promotional services for automotive dealerships; On-line advertising and marketing services.
The choice of services in the application is interesting in that it is looking to cover the use of the name for an advertising company. We’ll see if that is truly the intention here, or if it was an oversight when filing.
Waterhouse Hayes also previously filed a trademark application for BAKER MAYFIELD which was issued a non-final office action from the USPTO refusing registration. A response to that office action will need to clarify some of the goods/services listed in the application and Mayfield needs to provide consent of the use of his name since Waterhouse Hayes is the applicant. The response is due by 12/6/2018.
